Terms of Service

By downloading, installing, or using the LUNA AI Art Generator application ("LUNA," "the App," or "the Service"), you agree to be legally bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated herein by reference.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Rocket Digital Limited ("Company," "we," "us," or "our"), a company incorporated in Hong Kong.

If you are using LUNA on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms, and references to "you" include that organisation.

You must be at least 13 years of age to use LUNA. If you are under 18, you represent that you have obtained parental or guardian consent.

LUNA is an AI-powered art generation application available on iOS and Android. The App enables users to create original artwork, illustrations, and images using a variety of artificial intelligence models by providing text prompts, selecting artistic styles, and customising generation parameters.

Key features of LUNA include, but are not limited to:

• Text-to-image generation using multiple AI models
• Style presets and artistic filters
• Image editing and enhancement tools
• Gallery management and image export
• Subscription-based access to premium models and features

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

Certain features of LUNA require you to create an account. Account authentication is managed through Firebase Authentication. You may register using a valid email address or supported third-party sign-in providers.

You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Notify us immediately of any unauthorised access to your account
• Accept responsibility for all activities that occur under your account
• Not share your account with or transfer it to any other person

We reserve the right to terminate or suspend your account at our sole discretion, including for violations of these Terms, fraudulent activity, or extended inactivity.

You agree to use LUNA only for lawful purposes and in a manner consistent with these Terms. You must not use the Service to:

• Generate, distribute, or store any content that is illegal under applicable law, including content that infringes intellectual property rights, defames individuals, or constitutes hate speech
• Create child sexual abuse material (CSAM) or any sexual content involving minors — such use is strictly prohibited and will be reported to law enforcement
• Generate non-consensual intimate imagery (NCII) or deepfakes of real individuals without their explicit consent
• Harass, bully, stalk, threaten, or abuse any individual or group
• Produce content intended to deceive, defraud, or mislead others, including synthetic media used in disinformation campaigns
• Attempt to circumvent, disable, or interfere with any security features, rate limits, or content filters within the App
• Reverse engineer, decompile, disassemble, or otherwise attempt to extract source code from the App
• Use the Service for any automated scraping, data harvesting, or bulk generation activities without our prior written consent
• Violate any applicable local, national, or international law or regulation

We reserve the right to remove content and suspend or terminate accounts that violate this Acceptable Use Policy without prior notice.

LUNA's image generation capabilities are powered by various third-party artificial intelligence models and infrastructure providers, including but not limited to:

• OpenAI (including DALL-E models)
• Microsoft Azure AI services
• Replicate
• Fal.ai

AI-generated images are created algorithmically and may be unpredictable. We make no representations or warranties that:

• Generated content will be accurate, appropriate, or suitable for your intended purpose
• Generated content will not resemble real people, places, or existing copyrighted works
• The output will consistently meet quality or style expectations

You are solely responsible for reviewing generated content before using or sharing it. We are not liable for any claims arising from the content you generate, share, or distribute using LUNA.

The legal status of AI-generated content and its intellectual property implications may vary across jurisdictions and continue to evolve. You are responsible for ensuring your use of generated content complies with applicable law in your jurisdiction.

LUNA integrates with and relies upon the following third-party services to deliver its functionality. Your use of LUNA is subject to the terms and privacy policies of these services:

We are not responsible for the practices, terms, or content of these third-party services. Links or references to third-party services do not constitute an endorsement by Rocket Digital Limited. We encourage you to review the privacy policies and terms of service of each third party.

To the maximum extent permitted by applicable law, Rocket Digital Limited and its officers, directors, employees, agents, partners, and licensors shall not be liable for any:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, goodwill, or business opportunities
• Damages arising from your inability to access or use the Service
• Damages arising from unauthorised access to or alteration of your content or account
• Damages related to AI-generated content produced through the Service

In jurisdictions where the exclusion or limitation of liability for consequential or incidental damages is not permitted, our liability shall be limited to the fullest extent permitted by law.

In no event shall our total aggregate liability to you for all claims arising from or related to the Service exceed the greater of (a) the total amount you paid to us in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred Hong Kong dollars (HKD 100).

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

You agree to indemnify, defend, and hold harmless Rocket Digital Limited and its officers, directors, employees, agents, and licensors from and against any claims, actions, demands, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of or access to the Service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Any content you generate, submit, or distribute using LUNA
• Your violation of any applicable law or regulation

We reserve the right to assume exclusive control of the defence of any matter subject to indemnification by you, in which event you agree to cooperate with our defence of such claims.

These Terms remain in effect until terminated by either party.

You may terminate your account at any time by deleting it within the App settings or by contacting us at hello@rocketdigital.ai. Termination of your account does not entitle you to a refund of any unused subscription period.

We may suspend or terminate your account and access to the Service immediately, without prior notice or liability, if we determine at our sole discretion that you have violated these Terms, engaged in fraudulent activity, or if we are required to do so by law.

Upon termination, the following provisions shall survive: Sections 5 (User Content and Intellectual Property), 7 (AI-Generated Content Disclaimer), 9 (Limitation of Liability), 10 (Indemnification), 12 (Governing Law), and any other provisions that by their nature should survive termination.

These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People's Republic of China, without regard to its conflict of law principles.

Any dispute, controversy, or claim arising out of or relating to these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Hong Kong. You irrevocably consent to the personal jurisdiction of and venue in the Hong Kong courts.

If any provision of these Terms is found to be invalid or unenforceable under applicable law, the remaining provisions will continue in full force and effect. The invalid or unenforceable provision will be modified to the minimum extent necessary to make it valid and enforceable.

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by:

• Updating the "Effective Date" at the top of this page
• Displaying a notice within the App
• Sending a notification to the email address associated with your account (where applicable)

Your continued use of LUNA after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service and delete your account.
